In these Terms, “Toastee”, “we”, “us” and “our” refer to Bang Bang Creative Co (Pty) Ltd.
2. Acceptance and incorporated policies
These Terms apply whenever you visit Toastee, create an account, submit information, place an order or use any part of the website. By placing an order, you confirm that you have read and accepted these Terms, our Returns, Exchanges and Refund Policy, and our Privacy and Cookie Policy. Those policies form part of your agreement with us.
Nothing in these Terms limits any right or remedy that cannot lawfully be excluded under South African law.
3. Age requirements
You must be at least 18 years old and legally capable of entering into a binding agreement to place an order independently. A person under 18 may use the website or place an order only with the involvement and permission of a parent or legal guardian, who accepts responsibility for the order and use of the website.
4. Products and production
Toastee sells products under brands displayed on the platform. Unless expressly stated otherwise, the customer’s sale agreement is with Bang Bang Creative Co (Pty) Ltd trading as Toastee.
Most finished products are printed after an order is placed. Blank garments may be kept in stock. Products are not personalised with customer-supplied names, wording, photographs or artwork unless we expressly introduce and confirm such a service.
5. Product information and sizing
We aim to describe and display every product accurately. Colours may appear slightly different because of device displays, lighting and normal production variation. Product images may include digital mock-ups or styled photographs. Measurements in size guides are approximate, and the placement or scale of printed artwork may vary slightly between garment sizes.
Normal minor variations do not automatically mean that a product is defective. A product that is materially different from its description, damaged, defective or incorrectly supplied remains covered by the Returns, Exchanges and Refund Policy. Customers should consult the size guide before ordering.
6. Prices
All prices are displayed in South African rand unless stated otherwise. Bang Bang Creative Co (Pty) Ltd is not currently registered for VAT, so VAT is not separately charged or reflected on orders.
The price displayed at checkout, together with any clearly disclosed delivery charge or other amount, is the total payable amount. We may change prices at any time, but a change will not affect an order already accepted and paid for. If an obvious pricing or technical error occurs, we may cancel the affected order and refund the amount paid.
7. Orders
An order is submitted when checkout is completed and a payment method is selected. An automated acknowledgement confirms that we received the order; it does not prevent cancellation where payment failed, a product or required garment is unavailable, an obvious error occurred, fraud is reasonably suspected, fulfilment is unlawful or impractical, or necessary customer information is missing and not corrected.
If we cancel a paid order, we will refund the amount paid for the cancelled product or order. Once production has started, an order cannot ordinarily be amended. Customers must check products, quantities, colours, sizes, delivery details and contact information before paying.
8. Payment
Available payment methods may include Payfast, Yoco, Payflex, PayJustNow and any additional method displayed at checkout. Payment services are supplied by independent providers and their terms and privacy practices may apply.
Toastee does not ordinarily receive or store complete card details. We receive information such as payment status, transaction reference, amount and payment method. An order generally enters production only after payment has been confirmed.
9. Production and delivery times
Our normal production and processing period is approximately five to six business days. Courier delivery normally takes approximately one to two business days after dispatch. Customers should ordinarily allow approximately five to ten business days in total from confirmed payment to delivery.
These are estimates and may be affected by stock availability, order volumes, public holidays, infrastructure or service interruptions, courier delays, severe weather, incomplete information or other events outside our reasonable control. We will communicate a material delay where reasonably possible.
10. Delivery area and information
Toastee currently delivers only within South Africa. We do not currently offer international delivery or delivery to neighbouring countries unless expressly arranged and confirmed in writing.
The customer must provide a complete and accurate recipient name, address, postal code, email address and telephone number. If incorrect or incomplete information causes a failed delivery, rerouting, return to sender or additional courier charge, the customer may be required to pay the additional cost before delivery is attempted again. We cannot guarantee that an address can be changed after dispatch. This does not exclude responsibility where the problem resulted from an error by Toastee or its appointed courier.
11. Risk and lost parcels
Products remain at our risk until delivery has been accepted at the delivery address supplied by the customer. If an order is confirmed as lost before delivery, we will provide an appropriate replacement or refund. Where a parcel was delivered or misdirected because the customer supplied an incorrect address, we cannot guarantee recovery and the customer may be responsible for replacement or additional delivery costs.
12. Returns, exchanges and refunds
Returns, exchanges, defective products and refunds are governed by our Returns, Exchanges and Refund Policy. Because most products are printed after ordering, we do not offer an additional unrestricted return programme outside statutory rights and the voluntary size-exchange process described in that policy.
13. Customer accounts
Customers may check out as guests or create an account. You are responsible for accurate account information, keeping passwords confidential, restricting access to your device and informing us promptly if unauthorised use is suspected. We may suspend or close an account used fraudulently, unlawfully or in breach of these Terms.
14. Reviews and customer content
Customers may be permitted to submit reviews, ratings, photographs or other content. Content must be honest, based on a genuine experience, lawful, non-abusive, non-defamatory, non-discriminatory, free of spam or malicious code, respectful of privacy and not infringe another person’s rights.
You retain ownership of your original content but grant Toastee a non-exclusive, royalty-free licence to store, reproduce, format and display it for operating and promoting Toastee and its products. We may moderate, refuse or remove content that breaches these Terms, but will not remove a genuine negative review merely because it is unfavourable.
15. Intellectual property
The Toastee website, branding, software, layouts, product photography, graphics, wording and other original material are owned by or licensed to Toastee. Customers may use the website only for lawful personal shopping. No person may copy, scrape, reproduce, sell, modify, distribute or commercially exploit website content without prior written permission.
16. Marketing communications
We may send promotional email, abandoned-cart messages, SMS or WhatsApp marketing only where permitted by law and where the required consent or customer relationship exists. Marketing messages will identify the sender and provide an appropriate way to unsubscribe or object. Transactional communications about orders, payments, delivery, security and support are not marketing and may still be sent where necessary.
17. Website availability and third parties
We aim to keep the website available and accurate but do not guarantee uninterrupted or error-free access. We may temporarily suspend or change it for maintenance, security, upgrades or operational reasons. We are not responsible for third-party websites or services merely because they are linked from Toastee.
18. Liability
Nothing in these Terms excludes rights under the Consumer Protection Act, the Electronic Communications and Transactions Act, POPIA, or liability that cannot legally be excluded. To the extent permitted by law, we are not liable for indirect or consequential loss that was not reasonably foreseeable when the order was placed.
Customers must follow garment care instructions. We are not responsible for damage caused by misuse, incorrect washing, bleaching, ironing directly over prints, alteration, accidents or ordinary wear and tear.
19. Events outside our control
We will not be treated as being in breach where performance is delayed by an event outside our reasonable control, provided that we take reasonable steps to limit the effect and communicate material delays. This does not remove a customer’s non-excludable right to cancel or receive a refund where applicable.
20. Complaints and disputes
Please contact hello@toastee.co.za or use our contact form so that we can first attempt to resolve a complaint. A customer may also use any remedy available through a competent consumer ombud, regulator, commission or South African court.
21. PAIA manual
Our PAIA manual is being prepared for publication and will be made available on request. Requests or enquiries regarding access to records may be sent to the Information Officer at hello@toastee.co.za.
22. Governing law
These Terms are governed by the laws of the Republic of South Africa. South African courts will have jurisdiction, subject to any consumer’s right to approach another competent forum.
23. Changes
We may update these Terms when our services, providers, practices or legal obligations change. The version applying to an order will normally be the version published when the order was placed, unless a legal change must apply immediately.
